Elizabeth will moderate the breakout session “The Windows Are Open, Which Way Is the Coverage Breeze Blowing?” The breakout session will discuss how, after several years and high-profile cases following the first “look-back” windows were opened for childhood sexual abuse claims, insurance coverage law is following. Decisions on sufficiency of evidence, number of occurrences, direct action claims, and numerous related bankruptcies set the stage for lively debate and are moving towards resolution, allowing for restitution for survivors. I have the honor of moderating the breakout session “Where the Math Meets the Law (The Sequel).” Our panel will discuss recent developments in allocation, including new cases and concepts and how they can be modeled in complex insurance allocations in the contexts of litigating unresolved allocation issues, settlement discussions, and billing losses to unsettled insurers or under settlement agreements. Perspectives on Insurance Business Transfers in the U.S.,” Nick will be joined by Bradley Dlatt of Perkins Coie LLP for a discussion on the current landscape of insurance business transfers and corporate division laws in the U.S. and how policyholders, insurers, and other parties may be impacted by these options for insurers to divest legacy and run-off risks.

“Insurance Coverage for Climate Change Litigation: Disputes are Heating Up!” will be another roundtable where Diana will be joined by John M. Sylvester of K&L Gates LLP. Conversation will focus on disputes over insurance coverage for claims and lawsuits relating to climate change, whether for alleged environmental damage from selling fossil fuels or for potential misleading claims in corporate disclosure statements.

Robert will moderate the plenary panel “The Elephant in the Room: Why Diversity is Lacking in the Legal Profession and How to Embrace the ‘Uncomfortable’ Conversations and Move Forward.” He will lead a discussion around how Diversity, Equity and Inclusion (DEI) are critical to creating a space where everyone can thrive, and the question of how best to build a better profession is especially relevant for those in a leadership role. The panel will take a deep look at the experiences of different groups and explore why people avoid engaging in discussions about race and other forms of diversity. Topics will include micro-aggressions, what it means to be an ally, how “white fragility” hinders DEI efforts, and the intersectionality and plight of double and triple minority attorneys.
